1. Who processes your data

The data controller is HOME FOR YOU THAI CO., LTD. (registration No. 0205566046167), 159/23 Moo 12, Nong Prue, Bang Lamung, Chon Buri 20150, Thailand. We are the Home For You real estate agency.

Questions about your data: homeforyouthailand@gmail.com.

This policy covers the homeforyou.pro website, its blog and the agency’s Telegram chatbot. It is written under Thailand’s Personal Data Protection Act B.E. 2562 (PDPA). Section 9 adds what applies to citizens of Russia, and section 10 adds what applies to people in the European Union, the United Kingdom or Switzerland.

2. What data we receive

What you tell us. Your name, phone number, messenger, e-mail, city, property type and budget, comments and answers to our selection questions. Owners who rent out or sell property also tell us about the property. If you message us in a messenger app or the chatbot, we receive the conversation and the account details the app shows us: name, username, and phone number if you share it.

Another person’s data. A partner agent who uses the “Hand over client” form gives us the client’s name, phone and e-mail. By sending the form, the partner confirms that the client agrees to this.

What is collected automatically. IP address, browser and device type, pages viewed and actions on them, where you came from, advertising tags (UTM, yclid), identifiers of analytics and advertising cookies, time on page. Yandex Metrica’s Webvisor records mouse movements, clicks and scrolling. It does not record what you type into form fields: we have switched that off.

What is stored in your browser. The name, phone and e-mail from your last request, so you don’t have to type them again; advertising tags, for up to 90 days; your cookie choice. This stays on your device until you clear the site data in your browser. The tags are sent to us together with your request.

When you make a deal (not on the website), we receive your passport details and the information needed to verify a client under Thailand’s anti-money laundering law, and the details required for the contract. A copy of your passport is kept in our messenger conversation with you and with the developer.

We do not collect special categories of data (health, beliefs and the like). The website is intended for adults.

We cannot answer your request without your name and phone number (or e-mail). All other fields are optional.

4. Who we share data with

Agency staff who need it to handle your request.
Those who process data on our behalf: the contractor who runs the website, advertising and the server that receives requests (server in Moscow, Russia); amoCRM JSC, the CRM system where we keep requests (servers in Russia).
Analytics and advertising services: Yandex LLC (Metrica, Direct; Russia), Google LLC (Google Ads; USA), VK LLC (VK Ads; Russia), Meta Platforms, Inc. (Meta pixel; USA). They receive cookie identifiers and the fact that a request was sent, but not your name or phone number. These companies process their own data under their own rules.
Messenger apps — WhatsApp, Telegram and Line: we use them for our conversation with you, property selections and deal documents.
The developer you are buying from — the details needed for the reservation and the contract, including a copy of your passport. We do not pass client data to other companies.
Government authorities — when the law requires it.

We do not sell your data.

5. Transfers to other countries

The agency is in Thailand. Requests are stored on servers in Russia (the request server and amoCRM); the Google and Meta tags send data to the USA. Data protection in these countries may differ from Thailand’s and from the protection in your country. We transfer data there because it is needed to answer your request, and on the basis of your consent.

6. How long we keep data

Requests and conversations that did not lead to a deal — 3 years from the last contact. Then we delete or anonymise them.
Client data from a deal — 10 years after the relationship ends, as required by Thailand’s anti-money laundering law.
Server logs — 90 days.
Cookies — see the periods in our Cookie Notice. Data held by Metrica and advertising systems — under those services' rules.

If you withdraw your consent or ask us to delete your data, we delete it within 30 days, except for data the law requires us to keep.

7. Your rights

You can:

find out what data we hold about you and get a copy;
correct inaccurate data;
ask us to delete your data or restrict its processing;
object to processing, including selections, statistics and advertising;
receive your data in a machine-readable format to pass it to another controller;
withdraw your consent at any time — this does not affect processing before the withdrawal;
complain to a supervisory authority. In Thailand, this is the Office of the Personal Data Protection Committee (PDPC, pdpc.or.th).

Write to homeforyouthailand@gmail.com or to your manager. We reply within 30 days; citizens of Russia — within 10 working days. So that we don’t disclose data to the wrong person, we may ask you to confirm your identity.

8. How we protect data

Only staff who need requests have access to them, through personal accounts. The website and the request service use a secure connection (HTTPS). If a breach happens that may harm you, we will notify the PDPC and you.

9. For citizens of Russia

We process your data on the basis of your consent under Russian Federal Law No. 152-FZ “On Personal Data”. Requests are recorded and stored in databases in Russia (the request server in Moscow and amoCRM). Agency staff in Thailand work with them; Thailand is on the list of countries that adequately protect the rights of data subjects (Roskomnadzor Order No. 128 of 05.08.2022).

Your rights are set out in Articles 14–17 of Law No. 152-FZ. We answer requests within 10 working days; we may extend this by 5 working days if we tell you why. You can complain to Roskomnadzor (rkn.gov.ru) or to a court.

10. For people in the EU, the UK or Switzerland

The controller is the same company. Legal bases under the GDPR (and UK GDPR): answering your request — steps taken at your request before a contract (Art. 6(1) (b)); statistics, advertising and selections — your consent (Art. 6(1) (a)); client verification and taxes — legal obligation (Art. 6(1)©); spam protection — legitimate interest (Art. 6(1) (f)).

Statistics and advertising tags load only after you consent in the banner. You can change your choice in “Cookie settings” at the bottom of any page.

Your data is transferred to Thailand, Russia and the USA. There is no EU adequacy decision for these countries. By sending a request, you consent to this transfer (Art. 49(1) (a)).

In addition to the rights in section 7, you can complain to the supervisory authority of the country where you live or work.

11. Changes

The version date is at the top. We will announce significant changes on the website. If a change requires new consent, we will ask for it.
